Terms of Use
Effective and last updated: November 6, 2026
Please read these Terms carefully. They are a binding contract. Section 18 requires you and TrendArc to resolve most disputes by individual binding arbitration instead of in court, and it waives class actions and jury trials. You can opt out of arbitration within 30 days, as section 18.8 explains. Sections 4, 14 and 15 limit what we are responsible for.
1. Who we are and what these Terms cover
These Terms of Use (the "Terms") are an agreement between you and TrendArc Invest LLC, a California limited liability company ("TrendArc", "we", "us" or "our"). They govern your use of the website at trendarcinvest.com and everything offered through it, including its pages, tools, charts, data, accounts, emails, newsletter and paid plans (together, the "Service").
The Service offers charts and research tools for stocks, funds, currencies, metals and cryptocurrencies: price charts with indicators, drawing tools and alerts; a markets screener with our scores, technical readings and financial figures; research pages on the economy, sectors, market leadership and our own indexes; watchlists you can build and share; and a newsletter.
By using the Service or creating an account, you accept these Terms. If you do not accept them, do not use the Service. Our Privacy Policy and our Disclaimer are part of these Terms.
2. Who may use the Service
- You must be at least 18 years old and able to enter into a binding contract.
- The Service is offered to people in the United States. We make no claim that it is appropriate or available for use anywhere else. If you use it from outside the United States, you do so on your own initiative and you are responsible for following the laws that apply to you.
- You may not use the Service if the law bars you from doing so, including United States sanctions and export laws.
- If you use the Service for a company or other organization, you confirm that you may accept these Terms for it, and "you" includes that organization.
3. Research, not advice
TrendArc is a publisher of financial research and editorial commentary under the publisher's exclusion of the Investment Advisers Act of 1940. Our scores, indicators, regime readings, lists, charts and letters describe what our tools measure in the markets. They are impersonal: they are not tailored to you, and they are not a recommendation to buy, sell or hold anything. We are not a registered investment adviser, broker-dealer or financial planner, we do not manage anyone's money, and we cannot advise you on your own situation, including by email or in support conversations. Using the Service does not create an adviser, broker or fiduciary relationship between you and TrendArc.
You are responsible for your own investment decisions. Investing involves risk, including the loss of the money you invest, and past readings or results do not predict future ones. Historical, hypothetical or back-tested results, including any statistics about our scores, signals or models, have inherent limits: they are calculated after the fact, they do not reflect actual trading, and real results would differ. Consider talking to a licensed adviser before acting on anything you read here. The Disclaimer sets out the full framing.
TrendArc, its owners, employees and contributors may hold, buy or sell securities and other assets that appear on the Service, at any time, including in ways that differ from what a reading or a published portfolio shows. A portfolio we publish reflects our own decisions and circumstances; it is not a recommendation that you hold the same positions, and your results would differ.
4. Market data
The prices, company financials, estimates and other market data on the Service are supplied by third-party data providers, including our licensed data partners, and by public sources. Our scores, indicators, regime readings and figures such as P/E ratios and dividend yields are calculated by us from that data.
- Data may be real-time, delayed or end-of-day, and it may be out of date. A price shown while a market is open, or before or after its session, can come from a subset of trading venues and can differ from the official exchange price.
- Data can be incomplete, can be revised after we show it, and can be wrong. A figure we calculate can differ from the same figure published elsewhere, and some figures are not available for every security.
- Alerts, emails and other notifications are a convenience only. They can be late, can arrive more than once, or can fail to arrive, and they are no substitute for watching the market yourself.
- We do not guarantee the accuracy, completeness or timeliness of any data, and we are not responsible for its accuracy. Neither we nor our data providers are liable for errors, omissions, delays or interruptions in the data, or for any decision made or action taken in reliance on it.
- Market data stays subject to its providers' terms. You may use it on the Service for your own research; you may not copy, redistribute or resell it. Our data providers may rely on the disclaimers and limits in these Terms.
5. How you read the data is up to you
What the Service shows is information for your own research, not a conclusion about what you should do. How you interpret a price, chart, score, indicator, list or reading, and any decision you make with it, is yours alone: TrendArc takes no responsibility for your interpretation of the data or for the results of decisions based on it. Before you act on anything important, check it against an official source, such as the company's own filings or your broker.
6. Your account
- You can register with an email address and password, or sign in with Google. Signing in with Google creates a free account for your Google email address if you do not already have one.
- Give us accurate information, including a real email address you can receive mail at, and keep it up to date. We use it for sign-in links, account notices and alerts you set.
- An account is for one person. Keep your sign-in details to yourself; you are responsible for everything done under your account. Tell us at once at support@trendarcinvest.com if you think someone else has used it.
- You can stop using the Service at any time, and ask us to delete your account by writing to support@trendarcinvest.com.
7. Free and paid plans
The public pages and the Free plan cost nothing and need no card. What each plan includes is shown on the Pricing page. We may change, limit or end any feature or plan, including free ones, at any time.
Paid plans are not on sale yet. When they open, the following applies, together with the price, billing period and other terms shown when you buy:
- Automatic renewal. A paid plan renews automatically at the end of each billing period, and we, through our payment processor, will charge your payment method the price then in effect until you cancel. You authorize those charges.
- Cancelling. You can cancel at any time, online in your account or by writing to us. Cancelling stops the next renewal; you keep access until the end of the period you have paid for.
- Refunds. If you ask within 14 days of a charge for a yearly plan, whether a first purchase or a renewal, we refund that charge in full and end the plan, together with any founding rate on it. This refund is available once in any 12 months for each account. Monthly charges and partly used periods are not refundable, except where the law requires a refund or section 17 provides one.
- Price changes. We may change prices at any time. A new price applies to new purchases once it is posted, and to an existing plan from its next renewal. Where the law requires us to tell you about a change in advance, for example for an automatically renewing plan, we will do so as the law requires.
- Founding rates. A founding rate, where offered, applies as described on the Pricing page.
- Failed payments and disputes. If a payment fails, or you dispute a charge with your bank or card issuer, we may suspend or downgrade your plan until the matter is resolved.
- Taxes. Prices may not include taxes. You are responsible for the taxes that apply to your purchase, other than taxes on our income.
8. Email and electronic notices
If you subscribe to the newsletter, we email it to you on its regular schedule; every issue has an unsubscribe link. Service emails, such as verification, password resets, notices about your account and alerts you set, are part of running your account. You agree that we may give you notices, disclosures and other communications electronically, by email to the address on your account or on the Service, and that they satisfy any legal requirement that a communication be in writing.
9. Acceptable use
We want you to use TrendArc as much as you like for your own research. You may not:
- copy, scrape, crawl, download in bulk, cache, frame, mirror or resell our scores, rankings, indicators, lists, charts, data or pages, or use them to build or improve a competing product or to train or prompt an AI model;
- access the Service with bots, scripts or other automated tools, or overload it, except search engines indexing public pages as our robots.txt allows;
- get around plan limits, locks, meters or rate limits, share a paid account, or create several accounts to avoid limits;
- reverse engineer, probe, scan or test the vulnerability of our systems, or interfere with the Service or anyone else's use of it;
- use the Service for anything unlawful, including market manipulation, spreading false information about a security, or fraud of any kind;
- present our content as your own or as personal advice from us, or use our name, logos or trademarks without our written permission;
- publish lists or handles that are unlawful, misleading, infringing or abusive, or impersonate anyone.
Quoting a short excerpt of a reading with a credit and a link to TrendArc, for example in a post about a stock, is welcome.
10. Our content and intellectual property
The Service and its content, including our scores, indicators, methods, software, text, charts and design and the TrendArc name and logos, belong to TrendArc or its licensors and are protected by intellectual property laws. Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Service for your own non-commercial research. We keep all rights we do not expressly grant. Market data from our data providers is covered by section 4.
If you send us ideas, suggestions or feedback, we may use them freely and without any obligation to you.
11. What you save and publish
Watchlists, portfolio books, drawings, alerts and other things you save ("your content") stay yours. You give us a non-exclusive, royalty-free licence to store, copy, process and display your content as needed to run, secure and improve the Service. If you publish or share a list, you let us show it, with the handle you chose, to anyone who has the link, until you unpublish it. You are responsible for your content and confirm that you have the right to share it. We do not endorse content published by users, and we may remove any of it at our discretion. If you believe something on the Service infringes your rights, write to legal@trendarcinvest.com.
12. Services run by others
The Service works with services run by others, such as Google sign-in and, once paid plans open, a payment processor, and it may link to other websites. Those services are governed by their own terms and privacy policies. We are not responsible for them, their content or their availability.
13. Changes to the Service
We may change, suspend or discontinue any part of the Service, including features, data, plans and content, at any time and without notice, and we may set or change limits on its use. The Service may sometimes be unavailable, for example for maintenance or because of problems with our systems or our providers' systems. We are not liable to you for any of this, except as section 17 provides for paid plans.
14. Disclaimer of warranties
To the fullest extent the law allows, the Service and everything on it, including all data, readings and content, are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy, and any warranty arising from a course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure or free of errors, that defects will be corrected, that any data or content is accurate, complete or current, or that the Service will meet your needs or produce any particular result. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
15. Limitation of liability
To the fullest extent the law allows, neither TrendArc nor its members, managers, employees, agents, licensors or data providers (together, the "TrendArc Parties") will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or investments, or any trading or investment loss, arising out of or relating to the Service or these Terms, however caused and on any theory of liability, even if told that such damages were possible.
The total liability of the TrendArc Parties for all claims arising out of or relating to the Service or these Terms is limited to the greater of the amount you paid us for the Service in the twelve months before the event that gave rise to the claim, or US$100. These limits apply even if a remedy fails of its essential purpose, and they are an essential part of the bargain between you and us. Some states do not allow certain limitations of liability, so some of them may not apply to you. Nothing in these Terms limits any liability that cannot be limited by law.
16. Your responsibility for claims
To the extent the law allows, you will defend, indemnify and hold harmless the TrendArc Parties from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Service, your content, your breach of these Terms, or your violation of any law or of anyone else's rights. We may take over the defense of any such claim at our own cost, and you will cooperate with us.
17. Suspension and termination
To the extent the law allows, we may suspend or end your access to the Service, or close your account, at any time and for any reason, with or without notice. You may stop using the Service at any time. If we end a paid plan for a reason other than your breach of these Terms or a legal requirement, we will refund the unused part of the period you paid for; otherwise no refund is due. The parts of these Terms that by their nature should continue after your access ends, including sections 3 to 5 and 10 to 23, continue to apply.
18. Resolving disputes: arbitration and class action waiver
Please read this section carefully. It affects your legal rights, including your right to go to court.
18.1 Talk to us first
Before starting an arbitration or a court case, the party with a dispute must send the other a written notice that describes it and the relief sought: to us at legal@trendarcinvest.com, and to you at the email address on your account. Both sides will try in good faith to resolve the dispute informally for 60 days after the notice is received, and any limitation period is paused for those 60 days.
18.2 Binding individual arbitration
If the dispute is not resolved, you and TrendArc agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service, including their formation, interpretation, enforceability or scope and whether a dispute must be arbitrated, will be resolved by final and binding arbitration on an individual basis, except as section 18.3 provides and except that a court decides any question about the enforceability of section 18.4. The Federal Arbitration Act governs this section 18.
18.3 Exceptions
Either party may instead bring an individual claim in small claims court if it qualifies there, and either party may ask a court for an injunction to stop the infringement or misuse of intellectual property or unauthorized access to the Service, such as scraping. Nothing in this section waives a claim for public injunctive relief that the law does not allow to be waived; such a claim will be decided by a court after the arbitration of all other claims has finished, and the court case will be paused until then.
18.4 No class actions and no juries
You and TrendArc may bring claims against each other only in your or its individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate the claims of different people or preside over any class or representative proceeding, and may award relief only to the individual party seeking it and only as far as needed for that party's own claim. You and TrendArc each waive any right to a jury trial.
18.5 Rules and fees
The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, which are published on the AAA's website, before a single arbitrator. Filing, administration and arbitrator fees will be paid as the AAA's rules provide, which in consumer cases place most of them on the business. Each side pays its own attorneys' fees and costs unless the arbitrator awards them under the applicable law.
18.6 Hearings
The arbitration will be conducted by written submissions, video or phone where possible. Any in-person hearing will take place in the county where you live, or in another place we both agree on.
18.7 Mass filings
If 25 or more similar demands for arbitration against TrendArc are filed by or with the help of the same law firm or a coordinated group, the AAA's Mass Arbitration Supplementary Rules will apply to them, and the limitation periods of the demands that are waiting to be heard are paused until they are heard.
18.8 Your right to opt out
You can reject this arbitration agreement by emailing legal@trendarcinvest.com within 30 days after you first accept these Terms, from the email address on your account, with your name and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
18.9 If part of this section is unenforceable
If the class action waiver in section 18.4 is found unenforceable for a claim, that claim, and only that claim, must be severed and decided in court under section 19, and never in a class arbitration. If any other part of this section is found unenforceable, the rest of it still applies.
18.10 Changes to this section
If we change this section after you have accepted these Terms, the change will not apply to a dispute that either of us notified the other about before the change took effect.
19. Governing law and where cases are heard
These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the State of California, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs section 18. For any dispute that is not arbitrated, you and TrendArc agree to the exclusive jurisdiction and venue of the state and federal courts located in San Mateo County, California.
20. Time limit for claims
To the extent the law allows, any claim arising out of or relating to these Terms or the Service must be brought within one year after it arises, or it is permanently barred.
21. Changes to these Terms
We may change these Terms at any time by posting the updated Terms on the Service with a new effective date. Changes take effect when they are posted, unless the law requires otherwise, and apply to your use of the Service from then on. If you do not agree to a change, you must stop using the Service; by continuing to use it after a change takes effect, you accept the updated Terms. Section 18.10 limits how changes apply to the arbitration agreement.
22. General terms
- Entire agreement. These Terms, with the Privacy Policy, the Disclaimer and any terms shown when you buy a paid plan, are the entire agreement between you and TrendArc about the Service, and they replace any earlier understanding.
- Severability. If any part of these Terms is found unenforceable, it will be enforced to the greatest extent possible, and the rest of these Terms stays in effect.
- No waiver. If we do not enforce a part of these Terms, that does not waive our right to enforce it later.
- Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours, including to a successor in a merger, acquisition or sale of assets.
- Events beyond our control. We are not responsible for any delay or failure caused by events beyond our reasonable control, including failures of the internet, of our hosting or data providers, or of markets.
- Relationship. Nothing in these Terms creates a partnership, joint venture, agency, employment or fiduciary relationship between you and TrendArc.
- Who may enforce these Terms. Apart from the TrendArc Parties, who may rely on sections 4, 14, 15 and 16, no one other than you and TrendArc has rights under these Terms.
- Interpretation. Headings are for convenience only, and "including" means "including without limitation".
